1. Services
People Focused Media LLC. ("People Focused Media," "we," "us," or "our") provides school and sports photography services to schools, teams, and individual clients (collectively, "Client"). These services may include, but are not limited to, photographing school events, sports games, individual and team portraits, and action shots.
2. Photography Sessions
Scheduling: Client will be responsible for scheduling photography sessions with People Focused Media in advance. We will confirm all details, including location, time, and specific needs, upon booking.
Conduct: All participants in the photography session are expected to behave appropriately and follow any instructions provided by People Focused Media. We reserve the right to terminate a session due to disruptive or unsafe behavior.
Release Forms: For school events, a separate model release form may be required for each student photographed. Parents or guardians are responsible for obtaining and submitting these forms.
3. Payment and Fees
Payment terms will be outlined in a separate agreement or proposal provided to the Client before the photography session.
Payment is due in full before the delivery of any final images.
4. Delivery
People Focused Media will deliver final edited images to the Client electronically via a secure online gallery within 60 business days of the photography session.
The Client will be provided with download instructions and access credentials for the online gallery.
5. Copyright and Usage
People Focused Media retains all copyrights to the photographs.
The Client is granted a non-exclusive license to use the photographs for personal, non-commercial purposes.
6. Passive Digital Release
By participating in a photography session with People Focused Media, the Client grants us a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and display the photographs for the following purposes:
Our website (peoplefocusedmedia.com)
Social media marketing (including platforms like Facebook, Instagram, etc.)
Marketing materials (including brochures, flyers, etc.)
7. Opt-Out
If the Client wishes to opt-out of the passive digital release, they must send a written request to People Focused Media via email at peoplefocusedmedia@gmail.com. Please include the name of the student and the specific event or session in the request.
8. Disclaimer
People Focused Media is not responsible for lost, damaged, or corrupted digital files. We recommend that the Client back up all downloaded images.
9. Limitation of Liability
People Focused Media's total liability for any claim arising under these Terms and Conditions shall not exceed the amount paid by the Client for the photography services.
10. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of California.
11. Entire Agreement
These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and supersede all prior or contemporaneous communications, representations, or agreements, whether oral or written.
12. Severability
If any provision of these Terms and Conditions is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
13. Amendment
People Focused Media reserves the right to amend these Terms and Conditions at any time. We will notify the Client of any changes by posting the revised Terms and Conditions on our website.
